The tertiary decree, also known as the tertiary renovation decree, details the conditions for applying article 17 of the Energy Transition Law.
Applicable from 2022, this decree concerns the obligation to improve the energy performance of tertiary buildings in order to achieve a 60% reduction in energy consumption by 2050.
Who is concerned by the tertiary decree?
The tertiary decree requires owners and tenants of tertiary buildings of more than 1,000 m² to reduce their final energy consumption.
Indeed, all existing tertiary buildings of more than 1,000 m² are concerned. The obligation to reduce energy consumption applies to landlords as well as their tenants. This is the cumulative floor area of one or more buildings on the same land unit or on the same site.
Which buildings are concerned?
- Shops (including garages, food businesses, small-surface shops in a shopping centre…)
- Offices (estate agents, banks…)
- Storage areas (including industrial site stores…)
- Healthcare establishments
- Educational establishments
- Infrastructure for sports, leisure, transport
- Cafés, hotels, restaurants
- ERP, establishments open to the public.
It is possible to pool, consolidate and select buildings with high energy savings potential. High-performing buildings can compensate for those that are less so.

Step 3: Identify energy savings actions and implement the action plan
Identification of savings potential and implementation of a targeted action plan to reduce energy consumption via an energy audit. Implementation of the action plan. Monitoring of consumption trends. Submission of results to the OPERAT platform.
What are the penalties for non-compliance?
In the event of non-compliance, those subject to the obligation risk a fine of up to €7,500 and having their name added to a government website naming and shaming poor performers.
The sanction operates on the "Name & Shame" principle and market sanction mechanisms may result from this.
